End User License Agreement

1. Agreement

By installing, launching or playing Echoes of Creation (the "Game") you agree to this Agreement. If you do not agree, do not play. This Agreement is in addition to the Steam Subscriber Agreement, which governs your Steam account and purchases made through Steam.

You must be at least 13 years old to play, and, if you are under the age of majority where you live, you must have a parent or guardian's permission.

2. Your license

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play the Game for your own non-commercial entertainment. The Game, its code, art, music, characters, world and everything in it belong to us or our licensors. You may not copy, modify, reverse-engineer, decompile, or create derivative works of the Game, or rent, sell or sublicense it, except where the law expressly allows it.

Recording and streaming gameplay, and sharing screenshots, is welcome, including monetised videos, as long as you do not imply that we endorse you.

3. Your account

You play through your Steam account. You are responsible for everything done on it. Do not share, sell, buy, or lend accounts or characters, and do not let anyone else play on your account.

4. An online game in Early Access

The Game requires an internet connection and runs on our servers. It is in Early Access: features, balance, drop rates, prices, maps and items will change, sometimes significantly, and there may be bugs, downtime, maintenance windows and data resets announced in advance. We may change, suspend or end any part of the service.

5. Lumina and virtual items

• Lumina (the in-game premium currency) and all in-game items, gold, gear, mounts, pets, outfits and other virtual goods ("Virtual Items") are part of the Game's content. You receive a limited license to use them in the Game; you do not own them, and they have no real-world monetary value.
• Virtual Items cannot be exchanged for real money, cashed out, or transferred outside the Game. Trading between players is allowed only through the Game's own marketplace and trading features.
• Buying, selling or trading accounts, items, gold or Lumina for real money or anything outside the Game ("real-money trading") is prohibited.
• Purchases of Lumina are made through Steam and are subject to Steam's refund policy. Except where the law requires otherwise, purchases are final once the Lumina has been delivered and used.
• We may rebalance, rename, change or remove Virtual Items. If an item or balance was obtained through a bug, exploit or duplication, or through a payment that was later reversed, we may remove it.

6. Code of conduct

Everyone who plays agrees to these rules. They apply to in-game chat, character and guild names, and anywhere you are acting as a player of the Game (including our Discord).

You must not:

1. Threaten anyone — including other players, moderators and the developer — with violence or harm, or encourage self-harm.
2. Harass, insult or abuse others, including slurs, hate speech, or attacks based on race, ethnicity, nationality, religion, gender, sexual orientation, disability or age.
3. Post sexual content, other people's personal information ("doxxing"), spam, scams, or links to malicious sites.
4. Cheat: use hacks, bots, macros that play for you, memory editors, packet manipulation, modified clients, or any third-party program that gives an unfair advantage.
5. Exploit bugs: deliberately use a bug, duplication method or unintended mechanic to gain items, currency or advantage, or keep the results. Report bugs instead — honest reports are always welcome.
6. Engage in real-money trading (§5), or sell, share or buy accounts.
7. Impersonate the developer, a moderator or another player.
8. Interfere with the servers or other players' ability to play (attacks, flooding, deliberate crashing).

7. Enforcement

If you break this Agreement we may, depending on how serious it is: warn you, remove messages, mute you, remove Virtual Items gained improperly, suspend your account temporarily, or ban it permanently.

• Threats of violence, and cheating or exploiting for gain, can lead to an immediate permanent ban without a prior warning.
• A banned account loses access to the Game and to its Virtual Items, including purchased Lumina. Except where the law requires otherwise, no refund is given for an account banned for breaking this Agreement.
• We keep records — including the exact text of chat messages and the time they were sent — as evidence for enforcement decisions, and we may share them with law enforcement where we believe there is a real threat to someone's safety.
• If you believe a ban was a mistake, contact [email protected] with your character name. We review every appeal. Creating a new account to get around a ban is itself a breach of this Agreement.

8. What you write in the Game

Chat messages, names and other text you create stay yours, but you give us a worldwide, royalty-free license to store, display and moderate them to run the Game. We may remove or change any name or message that breaks §6.

9. Feedback and bug reports

Suggestions and bug reports are voluntary. We may use them freely to improve the Game without owing you anything.

10. Your data

To run an online game we process data such as your Steam ID, character and gameplay data, chat messages, purchase records, connection data (IP address), and — when the Game crashes or you send a report — a crash report containing the session log, your PC's hardware and settings, and related Windows error-log entries. How we use, keep and protect this data, and your rights over it, are described in the Privacy Policy: echoesofcreation.net/privacy.html.

11. Warranty and liability

The Game is provided "as is" and "as available", especially during Early Access. To the fullest extent the law allows, we make no warranties that it will be uninterrupted, error-free or that data will never be lost, and we are not liable for indirect or consequential losses, or for the loss of Virtual Items. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in this Agreement limits rights you have as a consumer that the law of your country does not allow to be limited.

12. Ending this Agreement

You may stop playing and uninstall the Game at any time. We may end this Agreement or your access under §7, or if we shut the Game down; if the Game is shut down permanently we will announce it in advance.

13. Changes

We may update this Agreement. We will announce significant changes in the Game or on our Discord; continuing to play after a change takes effect means you accept the new version.

14. Governing law

This Agreement is governed by the laws of Canada and of the province in which Torrano Dev is based, without regard to conflict-of-law rules, and disputes go to the courts of that province, unless the law of your country gives you the right to rely on its own consumer protection rules or to bring proceedings where you live.
